Please read these terms carefully before booking an appointment or using our services at Ink & Soul Tattoo Studio.

Welcome to Ink & Soul Tattoo Studio. These Terms and Conditions govern your relationship with Ink & Soul Tattoo Studio ("we," "us," "our") regarding the use of our services, including tattoo appointments, consultations, and any other services provided.

By booking an appointment, making a deposit, or receiving services at our studio, you agree to be bound by these Terms and Conditions. If you disagree with any part of these terms, please do not book an appointment or use our services.

1. Acceptance of Terms

By booking an appointment, making a deposit, or receiving any services at Ink & Soul Tattoo Studio, you acknowledge that you have read, understood, and agree to be bound by these Terms and Conditions in their entirety.

These terms constitute a legal agreement between you ("Client") and Ink & Soul Tattoo Studio. We reserve the right to refuse service to anyone at our discretion for any reason, including but not limited to safety concerns, inappropriate behavior, or violation of these terms.

Important: These terms include important information about deposits, cancellations, health risks, and liability. Please read them carefully before proceeding.

2. Age Requirement & Identification

All clients must be at least 18 years of age to receive a tattoo at Ink & Soul Tattoo Studio. No exceptions will be made.

Required Identification:

You must present a valid, government-issued photo ID at your appointment. We accept:

  • Driver's License or State ID
  • Passport
  • Military ID

We will make a copy of your ID for our records as required by state health regulations. Your information will be kept confidential and secure.

No ID, No Tattoo: If you fail to provide valid identification at your appointment, your session will be canceled, and your deposit will be forfeited.

3. Booking Policy & Deposits

All appointments require a non-refundable deposit to secure your booking date and time.

Deposit Amounts:

Deposit Details:

  • Deposits are non-refundable but will be applied to the final cost of your tattoo (except consultation-only deposits).
  • Deposits are transferable to a new appointment if you reschedule with at least 72 hours notice.
  • Deposits are valid for 12 months from the date of payment.
  • Multiple-session projects require a deposit for each scheduled session.

4. Cancellation & Rescheduling Policy

We understand that circumstances may require you to change your appointment. However, last-minute cancellations significantly impact our artists' schedules and income.

Rescheduling:

  • More than 72 hours notice: Your deposit will be transferred to your new appointment date.
  • 48-72 hours notice: 50% of your deposit will be forfeited; remaining 50% can be applied to rescheduled appointment.
  • Less than 48 hours notice: Your entire deposit will be forfeited. A new deposit will be required to book another appointment.

No-Shows & Late Arrivals:

  • No-show (missing appointment without notice): Your entire deposit will be forfeited. You will be required to pay a new deposit to book any future appointments.
  • Late arrival (more than 30 minutes): Your appointment may be canceled at the artist's discretion, and your deposit will be forfeited.

Artists' Time is Valuable: When you book an appointment, that time is reserved exclusively for you. Last-minute cancellations prevent other clients from booking that time slot.

5. Design & Concept Changes

Our artists invest significant time in designing custom tattoos. We accommodate reasonable design changes, but major revisions may affect scheduling and pricing.

Design Process:

  1. Submit your initial concept and reference images during booking.
  2. Your artist will create a custom design based on your input.
  3. You will see the final design at your appointment.
  4. Minor adjustments can be made at the appointment.

Design Change Policy:

  • Minor changes: Simple adjustments (size, placement, minor details) can be made at your appointment at no extra cost.
  • Major changes: Significant design changes or completely new concepts requested at your appointment may require rescheduling and an additional design fee.
  • Redrawing fee: If you request a completely new design after your artist has already created one, a redrawing fee of $50-$150 may apply, depending on complexity.

6. Health, Safety & Medical Conditions

Your health and safety are our top priority. Certain medical conditions may prevent you from getting tattooed or require special precautions.

Medical Contraindications:

You must inform your artist of ANY medical conditions, including but not limited to:

  • Pregnancy or breastfeeding
  • Diabetes (especially if poorly controlled)
  • Blood disorders or bleeding conditions (hemophilia, etc.)
  • Heart conditions or pacemakers
  • Immune system disorders
  • Skin conditions in the tattoo area (eczema, psoriasis, etc.)
  • History of keloid scarring
  • Recent surgeries or medical procedures
  • Current or recent infections
  • Any condition requiring blood thinners or immunosuppressants

Medications & Substances:

  • Blood thinners: Do NOT stop prescribed blood thinners without consulting your doctor. Inform your artist if you are on blood thinners.
  • Alcohol & drugs: Do not consume alcohol or recreational drugs 24 hours before your appointment. We reserve the right to refuse service if you appear intoxicated.
  • Antibiotics: If you are on antibiotics for an infection, you cannot be tattooed until you have completed the full course and the infection has cleared.

Health First: We may require a doctor's note for certain medical conditions. Your artist has the right to refuse service if they believe tattooing could pose a health risk to you.

7. Aftercare Responsibility

Proper aftercare is essential for proper healing and the final appearance of your tattoo. While we provide detailed aftercare instructions, ultimate responsibility for healing lies with you.

Client Responsibilities:

  1. Follow all aftercare instructions provided by your artist.
  2. Keep the tattoo clean and moisturized as instructed.
  3. Avoid submerging the tattoo in water (pools, oceans, hot tubs) for at least 3 weeks.
  4. Avoid direct sunlight on the tattoo until fully healed (4-6 weeks).
  5. Do not pick, scratch, or peel the tattoo during healing.
  6. Wear loose, clean clothing over the tattoo.
  7. Contact us immediately if you suspect an infection or have healing concerns.

Touch-Up Policy:

  • One complimentary touch-up is offered within 6 months of your original appointment, provided the tattoo was properly cared for.
  • Touch-ups are not included for tattoos that were not properly cared for during healing.
  • Touch-ups for tattoos older than 6 months may incur a fee.
  • Finger, palm, foot, and other difficult-to-heal areas may require additional paid touch-ups.

8. Liability & Risk Acknowledgement

Tattooing involves inherent risks. By receiving a tattoo, you acknowledge and accept these risks.

Acknowledged Risks:

  • Allergic reactions: Though rare, allergic reactions to tattoo ink can occur.
  • Infection: Despite sterile procedures, infections can occur if aftercare instructions are not followed.
  • Scarring: All tattoos involve some level of scarring, which varies by individual.
  • Ink spread/bleeding: Ink may spread slightly under the skin over time.
  • Color fading: All tattoos fade over time, especially without proper sun protection.
  • MRI complications: Tattoos may cause complications during MRI procedures.
  • Unsatisfactory results: Individual skin types, healing processes, and aging affect final appearance.

Release of Liability:

By receiving services at Ink & Soul Tattoo Studio, you release Ink & Soul Tattoo Studio, its owners, employees, and artists from any liability for:

  • Infections resulting from failure to follow aftercare instructions
  • Allergic reactions to tattoo ink
  • Scarring or keloid formation
  • Dissatisfaction with the final appearance of the tattoo
  • Any medical complications arising from pre-existing conditions not disclosed to the artist

Permanent Decision: Tattoos are permanent. While laser removal and cover-ups are options, they are expensive and not guaranteed to completely remove or cover the original tattoo.

9. Artist Rights & Intellectual Property

All designs created by Ink & Soul artists are considered intellectual property of the artist and/or Ink & Soul Tattoo Studio.

Design Ownership:

  • Custom designs created by our artists may not be tattooed by other artists without written permission.
  • Flash designs (pre-drawn designs) are available to any client on a first-come, first-served basis.
  • We reserve the right to refuse to copy or replicate another artist's work.
  • Artists may photograph your tattoo for their portfolio and promotional use.

Artist's Right to Refuse:

Our artists reserve the right to refuse service for any reason, including but not limited to:

  • Content they deem offensive, hateful, or inappropriate
  • Requests to copy another artist's work
  • Designs outside their style or expertise
  • Face, neck, or hand tattoos for clients without significant existing tattoo coverage
  • Any request that violates their artistic integrity

10. Privacy Policy

We respect your privacy and are committed to protecting your personal information.

Information We Collect:

  • Identification: Copy of government-issued ID (required by law)
  • Contact information: Name, phone number, email address
  • Health information: Medical conditions relevant to tattooing
  • Design information: Reference images, design preferences

How We Use Your Information:

  • To maintain health department records as required by law
  • To contact you about appointments and updates
  • To ensure safe tattooing based on health information
  • To create custom designs based on your preferences
  • For internal business operations and record-keeping

Information Security:

  • Paper records are kept in a locked, secure location
  • Digital information is protected with industry-standard security measures
  • We do not sell or share your personal information with third parties for marketing purposes
  • Records are retained for the period required by state law (typically 7 years)

11. Changes to Terms & Conditions

We reserve the right to modify these Terms and Conditions at any time. Changes will be effective immediately upon posting on our website.

Notification of Changes:

  • Major changes will be announced on our website and social media
  • The "Last Updated" date at the top of this page will reflect the most recent changes
  • Continued use of our services after changes constitutes acceptance of the new terms

Governing Law:

These Terms and Conditions are governed by and construed in accordance with the laws of the State of New York. Any disputes arising from these terms or our services shall be resolved in the courts of Brooklyn, New York.
