Terms & Conditions

Please read these terms and conditions carefully before using our services or engaging with Prestige Renovations for any home improvement projects.

1. Acceptance of Terms

By accessing our website, requesting a quote, or engaging Prestige Renovations for services, you acknowledge that you have read, understood, and agree to be bound by these Terms & Conditions. If you do not agree with any part of these terms, you must not use our services.

These terms may be updated periodically, and continued use of our services constitutes acceptance of any modifications. We recommend reviewing these terms regularly.

2. Service Agreements

All services provided by Prestige Renovations are governed by a written Service Agreement. This agreement includes:

  • Detailed scope of work
  • Project specifications and materials
  • Project timeline and milestones
  • Payment schedule and terms
  • Warranty information
  • Change order procedures

The Service Agreement must be signed by both parties before work commences. Any verbal agreements or understandings are not binding unless incorporated into the written Service Agreement.

3. Project Estimates & Quotes

3.1 Initial Estimates

Initial project estimates are provided based on preliminary information and site assessments. These estimates are subject to change based on final project specifications and any unforeseen conditions discovered during the project.

3.2 Binding Quotes

A binding quote will be provided after detailed project planning and will be included in the Service Agreement. This quote is valid for 30 days from the date of issue.

3.3 Unforeseen Conditions

If unforeseen conditions are discovered during the project (such as structural issues, water damage, or electrical hazards), additional costs may apply. We will notify you immediately of any such conditions and provide a revised estimate.

4. Payments & Billing

4.1 Payment Schedule

Payment terms are outlined in the Service Agreement. Typically, payments are structured as follows:

  • Deposit: 25% upon signing the agreement
  • Progress payment: 50% upon project commencement
  • Final payment: 25% upon project completion and client acceptance
4.2 Payment Methods

We accept payment by check, credit card, or bank transfer. Credit card payments may be subject to a processing fee of 2.9%.

4.3 Late Payments

Payments are due according to the schedule in the Service Agreement. Late payments may incur a fee of 1.5% per month (18% annual rate) on the outstanding balance. We reserve the right to pause work on the project until overdue payments are received.

5. Project Timeline & Delays

5.1 Estimated Timeline

The estimated project timeline is provided in the Service Agreement. While we make every effort to complete projects on schedule, timelines are estimates and not guarantees.

5.2 Delay Factors

Project delays may occur due to factors beyond our control, including:

  • Weather conditions
  • Material availability or delivery delays
  • Permit processing times
  • Unforeseen structural issues
  • Client-requested changes
  • Acts of God or force majeure events
5.3 Delay Notification

We will notify you promptly of any anticipated delays and provide a revised timeline when possible.

6. Change Orders

6.1 Definition

A Change Order is a written amendment to the Service Agreement that modifies the scope of work, materials, timeline, or cost of the project.

6.2 Requesting Changes

Any changes to the original scope of work must be requested in writing. We will provide a written Change Order detailing the impact on cost and timeline.

6.3 Approval Required

Work will not proceed on any changes until the Change Order is signed by both parties. Verbal authorization for changes is not binding.

7. Warranties & Guarantees

7.1 Workmanship Warranty

We provide a 2-year warranty on all workmanship from the date of project completion. This warranty covers defects in workmanship but does not cover normal wear and tear, damage from misuse, or issues resulting from improper maintenance.

7.2 Manufacturer Warranties

Materials and products installed by Prestige Renovations are covered by their respective manufacturer warranties. We will provide you with warranty information for all major components.

7.3 Warranty Claims

To make a warranty claim, contact us in writing with details of the issue. We will inspect the concern and determine if it is covered under our warranty. If covered, we will repair or replace the defective work at no additional cost.

8. Client Responsibilities

To ensure project success, clients are responsible for:

  • Providing accurate information about the project requirements
  • Securing necessary permits (unless included in our services)
  • Obtaining HOA approvals if required
  • Providing access to the worksite during scheduled hours
  • Removing personal belongings from work areas
  • Making decisions in a timely manner when requested
  • Providing a safe working environment for our team
  • Arranging for alternative accommodations if needed during major renovations

9. Liability & Insurance

9.1 Insurance Coverage

Prestige Renovations maintains comprehensive insurance coverage including:

  • General liability insurance: $2,000,000
  • Workers' compensation insurance
  • Commercial auto insurance

Proof of insurance can be provided upon request.

9.2 Damage to Property

We exercise reasonable care to protect your property during renovations. However, we are not liable for damage to existing conditions that are discovered during the project or for normal wear and tear.

9.3 Limitation of Liability

Our liability for any claim related to our services is limited to the total amount paid for the specific project giving rise to the claim. We are not liable for consequential, incidental, or indirect damages.

10. Dispute Resolution

10.1 Negotiation

In the event of a dispute, both parties agree to first attempt to resolve the issue through good faith negotiation.

10.2 Mediation

If negotiation fails, both parties agree to submit the dispute to mediation with a neutral third party before pursuing litigation.

10.3 Arbitration

If mediation is unsuccessful, disputes will be resolved through binding arbitration in accordance with the rules of the American Arbitration Association. Arbitration will take place in New York County, New York.

10.4 Attorney's Fees

The prevailing party in any dispute resolution proceeding is entitled to recover reasonable attorney's fees and costs from the non-prevailing party.

11. Cancellation Policy

11.1 Client Cancellation

Cancellation of a project after signing the Service Agreement but before work commences will result in forfeiture of the deposit. Cancellation after work has commenced will require payment for all work completed plus any costs incurred for materials ordered.

11.2 Our Right to Cancel

We reserve the right to cancel a project for reasons including but not limited to:

  • Non-payment
  • Safety concerns
  • Client harassment of our team
  • Discovery of illegal activities at the worksite
  • Inability to obtain necessary permits

12. Intellectual Property

All designs, plans, drawings, and specifications created by Prestige Renovations remain our intellectual property. Clients are granted a license to use these materials for the specific project they were created for. These materials may not be reproduced, distributed, or used for other projects without our written permission.

We retain the right to use photographs of completed projects for marketing purposes unless otherwise agreed in writing.

13. Privacy Policy

Our Privacy Policy, which explains how we collect, use, and protect your personal information, is incorporated into these Terms & Conditions by reference. Please review our separate Privacy Policy document for complete details.

We are committed to protecting your privacy and will not share your personal information with third parties except as necessary to provide our services or as required by law.

14. Governing Law

These Terms & Conditions are governed by and construed in accordance with the laws of the State of New York, without regard to its conflict of law principles.

Any legal action or proceeding arising under these terms will be brought exclusively in the federal or state courts located in New York County, New York, and you hereby consent to personal jurisdiction and venue in such courts.
